Before ending a lease for default, the leasing company must send written notice by registered post giving at least 7 days to put it right.
What is wrong
- Seizing the vehicle on the road by force or threats
- Taking the vehicle without the 7-day registered-post notice
- Using hired thugs or causing a breach of the peace
- A leasing business that is not registered with the Central Bank
What happens next
If you resist, the company cannot use force. It must go to the District Court, and you get 14 days to show cause.
The punishment
Forceful seizure can be a criminal matter for the police. Running an unregistered leasing business can bring up to 2 years in jail and a fine.
What you can do
- Read the notice and pay or settle arrears before its deadline
- Ask in writing for a full statement of arrears and charges
- Do not hand over the vehicle to people without ID and papers
- Call 119 or go to the police if force is used
- Ask about any CBSL relief scheme that applies to you
- Complain to the company, then to CBSL FCRD
