Draft · not yet checked by a lawyer
Open the interactive flowchartThe rule
Public servants can be disciplined only by the Public Service Commission or its delegated authority, following the Establishments Code procedure.
What is wrong
- Punishment without a charge sheet
- No chance to answer the charges or be heard
- Interdiction or transfer used as revenge
What happens next
Usually a preliminary investigation, a charge sheet, a formal inquiry, then the disciplinary order.
The punishment
Orders can range from a warning or fine to salary deferment, reduction, compulsory retirement or dismissal.
What you can do
- Answer the charge sheet in writing within the time given
- Ask for the documents and witnesses relied on
- You may have a defending officer at the inquiry
- Appeal a PSC order to the Administrative Appeals Tribunal within four weeks of receiving it
- The Tribunal must decide within two months; its decision is final under the Act
Where to get justice
Public Service Commission, then the Administrative Appeals Tribunal. A lawyer can advise on any Supreme Court fundamental rights option.
