If a parent or spouse with enough income refuses to support you or your child, you can apply to the Magistrate's Court for a monthly maintenance allowance.
Key points
- A child under 18 can claim from a parent.
- Children aged 18 to 25 who cannot support themselves can also claim.
- A disabled child of any age who cannot earn a living can claim.
- A spouse who cannot support themselves can claim from a spouse who neglects them (not if living in adultery or separated by mutual consent).
- Apply where you, the dependant or the other party lives.
What you can do
- Gather proof: birth or marriage certificate, and evidence of income and expenses.
- File an application at the Magistrate's Court (a guardian can apply for a child).
- Attend the inquiry. The court sets the amount based on income and needs.
- Payments usually run from the date you applied.
- Women seeking maintenance can get free help from the Legal Aid Commission regardless of income.
