Open the interactive flowchartThe rule
The Prevention of Terrorism Act is still in force in October 2026. It allows special arrest and detention orders outside the normal rules.
What is wrong
- Acts the PTA defines as terrorism-related offences
- Misuse: detaining people for speech, art or protest
- Not telling family where a detainee is held
What happens next
A detention order may be issued (s. 9). A Magistrate may visit places of detention. The Human Rights Commission can investigate PTA arrests.
The punishment
Penalties for PTA offences are set by the Act and can be severe. The normal Bail Act rules may not apply.
What you can do
- Find out where the person is held and ask for the detention order
- Inform the Human Rights Commission at once
- Get an attorney-at-law; ask for access to the detainee
- File a fundamental rights petition within one month of an unlawful arrest
- Watch for the new Protection of the State from Terrorism law, which may change these rules
