Open the interactive flowchartThe rule
The owner can recover land through court. But a person who possesses land adversely for ten years may gain title by prescription.
What is wrong
- Entering or building on land without permission
- Forcibly pushing out the person in possession
- Using thugs or force instead of the courts
What happens next
- If violence is likely, police can file the dispute in the Primary Court
- The Primary Court protects whoever was in possession on the filing date
- If someone was forcibly pushed out within two months before, they are put back
- Ownership itself is decided by the District Court
The punishment
- Court order to hand back the land and pay damages
- Criminal trespass can be punished under the Penal Code
- Breaking a Primary Court order is an offence
What you can do
- Act early; do not let ten years pass
- Do not use force; complain to the police
- Collect deeds, survey plans and tax receipts
- File a case in the District Court to declare title and evict
Where to get justice
Police station, Primary Court, or District Court.
