Open the interactive flowchartThe rule
The State may acquire private land only for a public purpose and must pay compensation based on market value.
What is wrong
- No proper notice shown on the land
- Taking possession before the legal steps
- Low or delayed compensation
- Land taken but not used for the stated purpose
What happens next
- Notice of intended acquisition; objections allowed (at least 14 days)
- Minister's declaration in the Gazette
- Notice calling for claims and an inquiry by the Acquiring Officer
- Award of compensation, then payment
The punishment
Once the process is complete the land vests in the State, and you are owed the awarded compensation.
What you can do
- Send written objections within the notice period
- Submit your claim with deeds and valuation proof
- Appeal the award to the Board of Review within 21 days
- Appeal to the Court of Appeal only on a point of law
- Ask about resettlement or LARC benefits for big projects
Where to get justice
Divisional Secretary (Acquiring Officer), Land Acquisition Board of Review, or the Court of Appeal.
