Open the interactive flowchartThe rule
Everyone is equal before the law. Public officers must act lawfully, fairly and without unreasonable delay.
What is wrong
- Not answering letters or delaying for months
- Decisions that are against the law or unreasonable
- Treating you differently because of who you are
- Refusing to give reasons for a decision
What happens next
The Ombudsman or Human Rights Commission can inquire, hear both sides and recommend that the office fix its decision.
The punishment
If the office does not act on a recommendation, the report goes to the President and Parliament. Courts can quash unlawful decisions.
What you can do
- Write to the head of the office and keep a copy
- Use a Right to Information request to get the file
- Complain in writing to the Ombudsman
- Complain to the Human Rights Commission within one month
- Fundamental rights petition to the Supreme Court within one month; or a writ in the Court of Appeal
