Same-sex relations: the current law

The rule

Penal Code sections 365 and 365A still make certain sexual acts between consenting adults, including same-sex acts, offences. Repeal has been proposed but not passed.

What is wrong

s. 365 covers sexual acts described as 'against the order of nature'
s. 365A covers 'gross indecency' between persons, in public or private
Both apply to men and women since a 1995 amendment
Acts with children or without consent are separate, serious offences

What happens next

Prosecutions of consenting adults are rare. A private member's bill to decriminalise was cleared by the Supreme Court as constitutional but was not enacted.

What you can do

Everyone has the right to equal protection and freedom from torture under the Constitution
Police must not harass, extort or force medical examinations without lawful authority
You can complain about police abuse or discrimination
Online threats or leaked images can be reported under online safety and harassment laws
