Sexual intercourse with a woman without her free consent is rape. Consent obtained by force, threats, fraud or while she cannot understand is not valid.
What is wrong
- Intercourse without consent or against her will
- Consent got by threats, fear or pretending to be her husband
- Intercourse with a girl below the legal age, even with her consent
- Intercourse with a wife who is judicially separated, without consent
- Other sexual assault, such as grave sexual abuse
What happens next
Police record the complaint, arrange a medical examination by a Judicial Medical Officer, and the Attorney-General prosecutes in the High Court.
The punishment
Rape carries long rigorous imprisonment, a fine, and compensation to the victim, as set by the Penal Code. Some cases carry a minimum term.
What you can do
- Go to a safe place and get medical care quickly
- Do not wash or change clothes before the medical examination, if you can
- Complain to any police station; ask for the Women and Children's desk
- You may ask that your name and identity are kept private
- Ask for protection under the victims and witnesses law
