Open the interactive flowchartThe rule
A summons orders you to come to court or answer a case by a set date. Ignoring it does not make the case go away.
What is wrong
- Not coming to court on the date
- Not filing your answer in a civil case
- Not attending as a summoned witness
What happens next
- Civil case: the court may hear it without you and give judgment (CPC ss. 84-85)
- Criminal case or witness: the court may issue a warrant for your arrest (CCPA s. 63)
The punishment
- Judgment entered against you, with costs
- Arrest warrant and possible remand
What you can do
- Check the court, case number and date
- See an attorney-at-law quickly
- If unrepresented, give the court your registered address, mobile and email (Form 16A)
- If a decree was made in your absence, apply to set it aside within 14 days of being served (CPC s. 86(2))
- If you cannot come for a good reason, inform the court before the date
