The Evidence Ordinance decides what a court may consider. Whoever wants the court to believe a fact must prove it (ss. 101-103).
What is wrong
- A confession made to a police officer cannot be used against the accused (s. 25)
- A confession made in police custody is not allowed unless made before a Magistrate (s. 26)
- A confession caused by a threat, inducement or promise is irrelevant (s. 24)
- Hearsay: oral evidence must be direct, from someone who saw or heard it (s. 60)
- Copies of documents are allowed only in special cases (ss. 64-65)
What you can do
- Keep original documents; courts normally need the document itself (s. 62)
- In a criminal case the prosecution must prove guilt
- An accused relying on a general exception, such as self-defence, must prove it (s. 105)
- Anyone who can understand questions and answer sensibly may be a witness (s. 118)
- Bring witnesses who saw or heard the facts themselves
- Ask your lawyer to object to evidence that breaks these rules
