A Magistrate can order a person to remove a public nuisance, such as a blocked road, a harmful trade or a dangerous building (s. 98).
What is wrong
- Blocking a public road, path or waterway
- A trade or process harmful to community health or comfort
- A building or tree likely to fall and injure people
- An unfenced well, tank or pit near a public place
What happens next
On a report or information, the Magistrate issues a conditional order to fix it by a set time. The person may appear and object.
The punishment
- Ignoring the order is punishable under the Penal Code (s. 100)
- The Magistrate can have the work done and recover the cost (s. 103)
- In urgent danger, an immediate injunction can be issued (s. 104)
What you can do
- Complain to the police, local authority or Public Health Inspector
- Collect photos, dates and neighbours' statements
- If the order is against you, appear before the deadline to object (s. 98(2))
- For private harm to you, a civil case may also be possible
