A child is accused of a crime
Draft · not yet checked by a lawyer
Open the interactive flowchartThe rule
A child under 12 cannot commit a crime. Aged 12 to 14, it depends on whether the child understood the act. Children are tried in a Juvenile Court.
What is wrong
- Keeping a child in a cell with adults
- Publishing the child's name or photo
- Questioning a child harshly without a parent
- Keeping a child in remand too long
What happens next
Police must keep the child apart from adults and may release a child under 16 on bond. The Juvenile Court sits separately and in private.
The punishment
The court focuses on reform: probation, supervision by a parent, a fit person order, or a certified or approved school.
What you can do
- A parent should go to the police station at once
- Ask for the child to be released to you on bond
- Get a lawyer or Legal Aid for the Juvenile Court
- Ask the probation officer for a report
- Remand can be ordered only 21 days at a time
