A customer won't pay you

Open the interactive flowchartThe rule
An agreement to pay for goods or services is a binding contract. Some agreements, like guarantees and land deals, must be in writing.
What is wrong
- Customer takes goods or services and does not pay
- Customer pays only part of the agreed price
- A guarantor refuses to pay the customer's debt
- Customer deliberately cheats with false promises
What happens next
Small disputes often go first to the Mediation Board. If not settled, you can sue in the Magistrate's or District Court.
The punishment
The court can order payment of the debt, interest and costs, and seize property to enforce it. Deliberate cheating can also be a crime.
What you can do
- Keep invoices, delivery notes, messages and signed agreements
- Send a polite written reminder, then a letter of demand
- Go to the local Mediation Board for small claims
- Sue on a written debt using the faster summary procedure
- Act early: claims have time limits (prescription)
Where to get justice
