If you trade under a business name, you must register it with your provincial business names registry before trading.
What is wrong
- Trading under a business name without a registration certificate
- Not reporting changes such as new partners or address
- Running a partnership without a written agreement
- Not registering with the tax office when tax becomes due
What happens next
The provincial registrar can check unregistered businesses and the matter can be prosecuted in the Magistrate's Court.
The punishment
In the Western Province, the fine is up to Rs. 2,500 under the 1990 Statute. Other provinces set their own fines.
What you can do
- Choose: sole owner, partnership or company
- Apply at the Divisional Secretariat or provincial business registry with your NIC
- Display the registration certificate at your business
- Get a TIN from Inland Revenue (needed to register a business from 1 Nov 2026)
- Check local council trade licences for your trade
